Court Upholds Bayelsa Governor's Removal of Otuokpoti CDC Chairman

The Bayelsa State High Court sitting in Yenagoa has upheld the decision of Governor Douye Diri to remove the Chairman of the Otuokpoti Community Development Committee (CDC), Mr Anthony Azibalua, citing procedural irregularities in the suit challenging the action.

Delivering judgment on Tuesday, 21 October 2025, in Suit No. BYHC/OHC/CV/29/2024, Hon Justice (Dr) S.W Amaduobogha ruled that the claimant had adopted an inappropriate procedure in initiating the case, thereby depriving the court of the jurisdiction to hear the matter.

Azibalua, who had served as CDC Chairman, had approached the court via an Originating Motion, seeking an order of certiorari to overturn his removal by Governor Diri.

In its ruling, the court struck out the suit and dismissed all reliefs sought, effectively affirming the Governor’s decision to relieve Azibalua of his position.

Reacting to the judgment, the Bayelsa State Attorney-General and Commissioner for Justice, Mr Biriyai Dambo, SAN, commended the ruling, describing it as a "well-considered decision."

He stated that the Governor’s actions were always guided by the pursuit of peace, order, and the overall progress of Bayelsa State.

Dambo further stressed that the Prosperity Administration under Governor Diri maintains a strict zero-tolerance policy towards acts capable of undermining the peace and stability of communities across the state.
